全球化背景下的法律文化转换与法律秩序重建

在当今世界全球化背景下,法律文化转型在知识理性主体和法律文化结构两个方面亟待重建,前者表现为公民民主观念、法治思想和人权意识的缺失,后者表现为法律制度文化不够健全和法律精神文化比较淡薄。在全球法律文化撞击下,现代法律秩序的变革使法律文化的解释理论既面临着传统法律文化的传承与创新的矛盾,又面临着传统法律文化与西方资本主义文化的矛盾。正确把握全球化背景下当代中国的法律文化转型以及现代法律秩序的时代走向,必须协调处理好古今中外法律文化的互动关系。

On the Transformation of Law Culture and Reconstruction of Law Order in the Context of Globalization

In wake of globalization, it is of urgent need for the Chinese law culture to transform in the aspects of the corpus of knowledge reasonableness and construction of law culture. In the former there exists a lack of awareness in democratic ideology, rule of law and human rights among average Chinese citizens. The latter is flawed with unsophisticated legal system and culture as well as weak spiritual culture in law and order. With respect hermeneutic theories in law culture, globalization has given rise to creative antinomy between traditions and innovations in domestic law culture and between Chinese and western law cultures alike. Henceforth, it is of vital importance to bring in positive interaction between the different elements mentioned above in transformation of the law culture in China.
