完善我国假释制度的若干思考

作为一种非监禁化措施和行刑社会化的重要手段,假释具有调动罪犯积极改造的内在力量的激发功能,并为罪犯由完全剥夺自由的监禁生活逐渐适应完全恢复自由的正常社会生活架设过渡的桥梁。本文对西方假释制度的发展和我国假释制度实践加以梳理后,指出我国的假释制度在适用范围、适用条件和监督管理方面仍需要加以完善,以适应行刑社会化的要求。

A Deliberation On Parole System in Our Country

The parole system, an important non-custody sanction and socialized sentence execution, may allow offenders an encouraging function that may intrigue the potentials inherent in offenders for rehabilitation and build up a bridge for offenders to gradually go back to normal social lives from a completely freedom-free life in jail. Through a thorough study of the development of parole systems in west countries and the practice the system in our country, the article concludes that our parole system, whether in terms of its applicable extension, its applicable conditions and its administration and supervision, shall be consummated to meet the needs of socialization of sentence execution.
