试析我国《反垄断法》垄断协议概念的形式逻辑问题

反垄断法中垄断协议的概念存在以下逻辑问题,缺少"邻近的属概念"、概念的划分标准不统一、外延列举未穷尽。这些问题的存在及其所处的位置表明,这个概念只是横向垄断协议的概念,而不是垄断协议的概念。需要完善上述三项内容并适度调整这个概念的位置才能合理发挥其解释、说明的功能。

On the Formal Logic Problems of the Concept of Monopoly Agreement in the Anti-Monopoly Law of China

In the concept of Monopoly Agreement in Anti-Monopoly Law,there exist the following logic problems: the lack of adjacent generic concepts,non-uniform criteria for the classification of concepts,and denotation not exhaustively listed.The existence of these problems and the position of this concept indicate that this concept only refers to horizontal Monopoly Agreement instead of Monopoly Agreement.To fulfill the explanatory and interpretative function of this concept,the above mentioned problems need to be solved and the position of the concept should also be properly adjusted.
