消费者知情权与消费者保护

摘    要:消费者保护经历了从消费者运动到消费者权利的发展阶段。由于信息不对称是消费者问题产生的根源,在各项消费者权利中,消费者知情权成为解决整个消费者问题的起点和关键。消费者知情权具有基础性、核心性地位,是消费者自由选择权、公平交易权和消费安全权实现的前提和手段,与受教育权、意见被听取权及监督批评权存在相互交叉重叠的关系。消费者知情权还集中体现了消费者保护的预防保护理念,在消费者保护中具有重要地位。

Abstract:In history,consumer's protection has gone through two development stages:consumer's movement and consumer's right. Consumer's right to know becomes the initial point and key of solving consumer's problem because of information asymmetry between consumers and managements. As basis and centrality,Consumers' right to know is the precondition of realizing consumers choice right,consumers fair deal right and consumers safety right. There are cross reference between Consumer's right to know and consumers education right,consumers oversight righted. Consumer's right to know occupies an important position in consumer's protection by focusing on the idea of being against infringe from false or misleading information.
