农业补贴与反补贴立法统一性论析

农业补贴与反补贴具有内在统一性，二者概念关联、动态界分和享有共同的公平观。我国现有农业补贴反补贴立法采取的结构二分模式，人为地割裂了农业补贴与反补贴的内在联系，使得我国农业补贴反补贴制度不免具有内生缺陷。必须改变传统农业补贴与反补贴制度在立法上的二分模式，回归统一立法理念，以整体性思维从立法思路、立法模式、性质定位、价值、目标与基本原则等方面重构我国农业补贴与反补贴制度。

On the Unity of Agricultural Subsidies and Countervailing Legislation

Agricultural subsidies and countervailing are inherent unity. China＇ s current agricultural subsidies and countervailing legislation took the dual structure, separating the inherent relations between them. It caused many intrinsic problems that were difficult to overcome, such as lack of clear support for subsidies. It is necessary to change legislation model from the dual structure to unitary structure, perfecting our agrieuhural subsidies and countervailing legislation including ideas, nature, values, objectives and basic principles and so on.
