| 摘 要： | 文章从宋律(<宋刑统>)对唐律(<唐律疏议>)内容紧密承袭的事实出发,通盘论述赎刑制度自宋代以来的演变,揭示了赎刑作为一种官僚的法律特权在宋代所呈现出的日渐下移的趋势,同时就夷俗与汉法在宋代边疆地区的冲突,给赎刑制度以应有的历史评价.

| Abstract: | Given the fact that Song Dynasty's penal code Songxingtong had close coherence with Tang Dynasty's Tanglushuyi in contents, the article aims to dwell on the evolution of the crime-redeeming system in the two dynasties,trying to disclose that the crime-redeeming system,as a special right for the bureaucracy,gradually moved down to the lower level of the society.Simultaneously,the system covers the conflicts between Barbarian law and Hans' law in bordering regions.The article finally points out the historical significance of the crime-redeeming system. |
