| 摘 要： | 随着社会经济、政治和文化的发展，12世纪的西欧开始形成孕育自然权利话语的语境。结果，在教会法学者对《教会法汇编》所作的注释之中，iusnaturale一词开始具有个人的一种官能、能力、权、人身、婚姻和同意四种自然权利。它们充分证明：至迟到12世纪，自然权利话语已经出现。力或自由行动的范围等含义；与此同时，世俗的法律文件也涉及或提出了自然权利问题，《大宪章》就集中提出了财产

| Abstract: | Along with the economic,political and cultural development,Western Europe started to form the context of natural rights language in the 12th century.As the results,the word of ius naturale began with the meaning of a faculty,ability,power or a zone of autonomy in the canonists’ glosses on the Decretum.At the same time,secular legal files also concerned or represented the problem of natural rights.Magna Carta focused on four kinds of natural rights including property,person,marriage and consent.These facts have fully proved that natural rights language had appeared no later than the 12th century. |
