| 摘 要： | 《社会保险法》的出台为我国养老保障体制奠定了基本框架。应当承认，这部法律对我国目前社会发展中出现的种种问题进行了积极的回应。在我国宪政法治建设的历程上具有里程碑的意义。但同时也应当看到．其确立的养老保障体制仍亟待改善。养老保障体制的完善应当遵循我国建设“以人为本”的社会主义宪政国家的要求．关键是要从“人的尊严”出发。确立养老保障体制中的国家义务本位，构筑“以人为本”的养老保障体制。只有这样。才能实现向人权这一宪政主义终极价值理念的回归，也只有这样的养老保障体制．才是真正符合我国建设以人为本社会主义宪政国家历史大局要求的制度体系。
