| 摘 要： | 航空旅客在空难中死亡、伤残、惊吓、行李毁损或遗失、航班延误、超售和拒载等情形下都可能遭受精神损害,由此引发了不同类型的精神损害赔偿。航空旅客精神损害赔偿是否应有限额,立法与司法存在差异;航空旅客精神损害事实、因果关系、赔偿数额以及法律适用的判定等均与法官自由裁量权密切相关。

| Abstract: | Air Passengers can suffer mental distress in many cases such as Passengers death;wounded and disabled;frighten;luggage damage or lose;flight delay;overbooking;rejecting carriage and so on.Various mental injury compensation and limits have some difference in legislation and judicial adjudication.Judge has greater free discretion on damage fact;causation;amount of damages;reference to the law in action for compensation of passengers mental distress. |
