| 摘 要： | 农村宅基地闲置已成为一种较普遍的现象,而农村宅基地流转虽有利于土地利用效率的提高,却与现有的法律相抵触。针对农村宅基地流转所处的两难境地,在现有的土地制度和法律框架下,提出了建立农村宅基地储备制度的构想,对农村宅基地储备制度的目标、宗旨进行了定位,并对其组织机构、组织职能和运作机制进行了设计,尤其是对其资金运作机制做了深入的探讨。在实际中,农村宅基地储备制度应该根据地方特点,通过实践逐步改进和完善。

| Abstract: | It is common that some of the rural residential land is idle while the action of its transference conflicts with the existing law despite its contribution to increasing the efficiency of land use.Aimed at resolving this problem,this paper proposes that rural residential land banking system should be built in the context of the existing land institution and law.And it tries to design its organization framework,function and operation mechanisms.Especially,the capital operation is analyzed in detail.In practice,the rural residential land banking system should be improved and perfected gradually according to the local features. |
