| 摘 要： | 契约相对性原则是契约法的基本原则。它曾经严格限定了契约责任的范围。随着契约相对性原则被突破 ,契约对第三人的保护力度得以加强。无论是德国法上的附保护第三人利益的契约 ,还是美国商法典中的利益第三人担保责任 ,都扩大了契约对第三人的保护效力 ,从而使契约对第三人的保护问题有了新的发展

| Abstract: | The principle of relativity of contracts is the basic principle of contract laws. It had strictly limited the scope of responsibility of contrcts. Along with the break up of contract's principle of relativity, the protective force of contracts for the third persons has become stronger. The contracts that carry the attachment of protecting third persons' benefits required by German laws, and the responsibility of guaranteeing protection for third persons concerned with the benefit stipulated on the Code of Commercial Laws of the United States have both enhanced the protective effect of contracts for the third persons, and thus bringing about new developments on the question of requiring contracts to protect the benefits of third persons. |
