| 摘 要： | 独立量刑程序如何在我国刑事诉讼法中生长并发挥效用，是一个值得各方参与探讨的问题。英美法系国家定罪和量刑程序的分离模式对我国量刑专门程序的构建有重要的借鉴价值，结合我国刑事审判实际及量刑程序缺失的现状，吸收和借鉴英关法系国家先进做法，构建中国相对独立的量刑程序，具有很强的可行性和必要性。

| Abstract: | How independent sentencing procedure can grow and work in China＇s criminal procectures law is a question worthy of exploration. The separation of conviction and sentencing procedures in Anglo-American law is enlightening for China＇ s construction of special procedures of sentencing evaluation. Based on China＇s criminal trial practice, it is feasible and necessary to absorb and learn from the advanced practices of Anglo-American law system and build China＇s relatively independent sentencing procedures. |
