德法共治--解决"社会乏力症"的必由之路

人类社会有着共同的发展规律 ,世界各国都经过了从“德治—德法共治—人治—法治”的发展轨迹。但随着纯粹法治的推行 ,却带来了“社会乏力症”的弊端 ,并已成为世界性的热点问题 ,而我国却很少有人关注这一问题。本文分析了当代法治国家“社会乏力症”在我国的表现形式及其成因 ,论证了新层次的“德法共治”是解决当代各国“社会乏力症”的有效办法 ,并提出了落实“德法共治”主张的基本思路

Rule of Law with Virtue-A Perpetual and Universal Principle for Attribution in the Civil Law

As the common law of the development of human society, all countries around the world have experienced the process of "rule of virtue to rule of law with virtue to rule of man to rule of law". However, the practice of rule of law brings about a world wide social evil-"social weariness", which has not yet caught the attention. This article analyzes the forms of expression and the causes of the "social weariness" in China, then proves that an effective approach to the "social weariness" is the new "rule of law with virtue", and finally proposes the fundamental ideas in implementing the "rule of law with virtue".
