在投保人预付保险费后至保险合同成立前的所谓的“保险空白期”内,如何界定保险人的保险责任,以充分保护被保险人和受益人的权益,在各国和地区保险法上已经形成了系统的制度和理论.在归纳各国和地区在保险责任开始问题上形成的立法例、司法判例和理论成果的基础上,根据我国保险法的规定,以保险责任开始的属性、正式保险单的保险责任开始、暂保保险的规则、临时保险制度和追溯保险制度等问题为重点,对保险责任开始的认定标准和法律对保险责任开始的干预规则进行研究,在保护被保险人和受益人利益的立场上,解决“保险空白期”的保险责任承担问题.
