我国信用体系的构建与商法的完善

良好的信用是市场经济的基础,完善的社会信用体系是市场经济健康发展的重要保障。信用是商法的道德基础,商法是信用的制度保障。我国信用体系的主要问题是:社会普遍缺乏现代市场经济条件下的信用道德规范;信用信息公开方面无据可依,信用数据市场化程度低,信用中介服务的市场化程度低,国家信用管理体系不健全,缺乏有效的失信惩罚机制。应在信用管理的宏观规制、信用信息公开、培育信用中介机构、建立惩罚、约束机制等方面完善我国的商法体系。

The Construction of the Credit System and the Complete of the Commercial Law

The good credit is the foundation of market economy; the complete social credit system is the important safeguard for the healthy development of market economy. Credit is the moral foundation of the commercial law; the commercial law is the safeguard of credit. The main problems that exist in the credit system of our country are: there are universally short of credit moral norms under modern market economy condition; there are no basis to depend on in the respect of open information; the credit data marketization and the credit medium service marketnization are in low level degree; the state management system is not sound and there is short of effective credit punishment mechanism there,- It is necessary to perfect the commercial law system of our country in the respect of macroscopically normalizing the open of credit information; cultivating medium service structure; construction of punishment and limitation structure and so on.
