| 摘 要： | 《合同法》规定了代位权制度,填补了我国民事法律制度的一项空白。但在实践操作中对代位权行使的范围存在较大争议。本文从代位权行使范围的立法规定入手,对债权人的债权、债权人行使代位权支出的必要费用由谁承担等问题进行了分析,从而对代位权的行使范围进行了界定,以期有利于代位权制度的完善。

| Abstract: | "Contract law" has authorized subrogation right,which fills the blank of the criminal law system in our country.However,it is quiet controverisal about how much power should be given to those who are in possession of subrogation right in operation of real life.This paper starts from the legal definition related to the range of power the subrogation right holds,then it probes into the problems like these:who is supposed to pay for the fees which the creditor'operation of the subrogation right costs,the contact right of the creditor.All of these analyses contribute to the definition of the power spectrum of the fubrogation right so that the perfection of the subrogation right system could be expected. |
