透视我国外资法的修改

自1979年颁布《中外合资经营企业法》至今,我国已颁布200多项鼓励、引导、管理外商投资的法律法规,形成了相对健全的国际投资法制环境。但有些规定不符合《TRIMs协议》的要求,为了适应进一步扩大对外开放的形势和加入世界贸易组织的需要,我国根据《TRIMs协议》和对外承诺,对外商投资企业法律法规作了大幅度的修改,从中可以预测我国外资法的发展方向。

An Observation on Amendment to the Laws of Foreign Investment

Since the promulgation of the Law of Sino-Foreign Joint Ventures in1979,more than200laws and regulations have been enacted in China to encourage,guide and manage foreign in-vestment ,and this has created a relatively sound legal environment for international investment.Yet,since China's entry into WTO,some existing laws and regulations do not conform to the needs of TRIMs Agreement.So,some amendments must be made to the irrelevant laws so that they are in line with our policy of opening to the outside and the rules of WTO.Also,in doing so,the author believes that this will framework our foreign investment law in the future.
