| 摘 要： | 物权法车位归属条款在立法方法上偏离了立法目的,规范其语言缺陷是车位归属条款司法解释出台的缘由。这一司法解释将判定车位空间归属依据回归了区分所有权的基本法理,但使物权法车位归属条款的功能有所弱化,需要协调两者之间的关系。车位归属司法解释本身也存在一些歧义,因而在适用中需要作出进一步解释。
