| 摘 要： | 作为一项重要的物权制度,占有的法律价值主要体现在秩序价值、公平价值和效率价值三个方面。从价值的角度来看,我国《物权法》中关于占有的规定还存在一些不足,需要在明确占有权利、确立公示公信、补充权利推定三个方面加以完善。

| Abstract: | As an important property system, Possession has high legal value in the exploitation of property. In modern civil law, the legal values of possession are mainly expressed as the value of keeping social order, the value of justice and the value of efficiency. From the legal values of Possession, we can see the shortcomings of the property law of China. It is necessary that we should make some adjustment to the property law in the mentioned areas. |
