| 摘 要： | 惩罚性赔偿是以损害补偿为核心的我国侵权责任法中的一个亮点。虽然其在侵权责任法中只有一个条文,但对大规模的产品侵权案件能起到一定的遏制作用。我国产品责任的惩罚性赔偿规定在适用时存在着与其他法律的适用协调、主观条件限制过窄、损害结果不明、赔偿标准不确定等问题,需要进一步完善。对于惩罚性赔偿的赔偿标准,可以通过划定基准范围、设定最高限额、增加参考因素的方式予以确定。

| Abstract: | Punitive damages is a highlight in the tort law of our country which is at the core of damage compensation.It is only one article in the tort law but can contain large-scale infringement.The regulations of punitive damages still have some problems when it is applied based on the application conditions of tort law,so it need to be improved.As for the standard of punitive damages,we can determine the benchmark,set top limit,add more reference factors to achieae. |
