全球化时代的中国法治

以经济全球化、公共事务全球化、人权全球化、环境全球化、法律全球化为主要内容的全球化, 表征当今人类社会的综合性发展趋势, 从各个方面推动着中国法制的第三次变革。中国在加入世贸组织前后进行的大规模法律法规规章清理、修改及中国加速融入全球治理结构, 标志着这次法制变革的开始。这次变革包括: 政治法律体制改革、法律体系重构及法的精神的转换。这表明, 在未来的法律发展进程中, 我国法律的现代精神、全球精神、人类文明普适精神、法律的职业共同体的职业精神等将更加鲜明, 更进一步贯通整个法律体系和法律的运行机制。

Chinese Constitutionality in Globalization Era

Globalization that regarded economic globalization,public affairs globlization,human rights globalization,environmetal globalization as the main content,signifies the comprehensive development trend of the human society, and it is promoting the third legal system of China to improve from all respects. The rule of extensive laws and regulations that China carries on before and after the accession to the WTO is cleared up,revised, and incorporated the global administration structure with higher speed,marking the beginning that this law improves. This change includes: reform of politics and legal system, reconstructing of the system of law; transform of sprit of law. All of these indicate that development in process in the future law, modern spirit, global spirit,general right spirit of human civilization,job spirit of the legal professional community will be more distinctive,verse in the whole legal system and operating mechanism of the law to go still one step further.
