论非刑罚化的生成及其实现途径

世代对立的报应刑理论和预防理论的论争导致目的刑思想在世界范围内盛行,这为非刑罚化生成提供了理论基础,刑罚谦抑性、人道化理念和轻轻重重的刑事政策把非刑罚化思想推向了成熟。非刑罚化从制度设置上就是指刑罚宣告的回避、刑罚执行的回避以及犯罪人的社会化处遇。但是我国刑事立法和司法领域长期以来对非刑罚化的存在持一种否定态度,因此,应该从犯罪结果的非刑罚化和刑罚执行的非刑罚化两个层面上建立和完善我国的非刑罚化制度。

On the Formation and Fulfilment of Depenalization

The argument between retribution and prevention theory of punishment result in boom of purpose theory of punishment throughout the world,which precipitates formation of depenalization.Moderation,humanization theory of punishment and criminal policy of "lighter and heavier punishment" reflect maturity of depenalization theory.Institutionalization of depenalization means that we should exclude declaratory penalty and enforcement punishment,exercise criminal sociality treatment.But criminal legislation and jurisdiction have objected depenalization for a long time,we propose that we should establish and improve Chinese characteristic system of depenalization in accordance with criminal consequence and execution of punishment.
