| 摘 要： | 《刑法修正案(八)》基于宽严相济刑事政策的考量,降低了盗窃罪的入罪门槛。入户盗窃、携带凶器盗窃、扒窃行为等归为盗窃罪,扩张了盗窃罪的犯罪圈。随着盗窃罪的修改,相关法律适用和司法实践也将随之发生重大变化。为此,需要对盗窃罪进行重新解读。

| Abstract: | "The Criminal Law Amendment Act(The Eighth) ",in line with the criminal policy of combining punishment with leniency and harshness,lower the standard of larceny to include burglary,armed theft and purse-cutting in it,and thus expand its scope.With the amendment of larceny,related laws and judicial practice will change dramatically in the future.Therefore,the rules of larceny need to be reinterpreted. |
