| 摘 要： | 本文从判例法的概念及其产生的历史背景分析入手,在详细论述判例法的优缺点后就我国能否引进判例法问题进行了探讨.作者认为判例法是英美法系国家独有的一种法律渊源.我国既无引进判例法所需的历史积淀,也无判例法生存并发展所需的主客观条件.我国不宜引进判例法.

| Abstract: | This paper first discusses some important theories related to the precedent law in terms of its concept, history, advantages and limitations. Then it explores the future of the precedent law in China by drawing attention to the fact that the precedent law only exists in the countries in which common law system exists but China lacks such historical and social conditions the precedent law needs. The exploration leads to the conclusion that the precedent law is not likely to be introduced in China. |
