随着我国社会主义市场经济的快速发展,超额保险问题在我国的司法实践中日益频繁地出现并困扰着许多法律实务工作者,特别是在我国《保险法》对于超额保险规定不够规范的情形下,这一问题就越发显得十分突出。从一起保险案例谈起,结合国外超额保险法律的经验,剖析超额保险制度的法理基础与立法实践,对如何解决我国超额保险制度问题作了探讨。

A Legal Research of Excess Insurance:an Insurance Case Study on How to Consummate China's Insurance System

The excess insurance system is of great theoretical and realistic significance in China's Insurance Law.However,with the rapid development of the socialism marketing economy and the increasing progress of the harmonious society in China,the issue of excess insurance appears increasingly frequently in the judicature practice and puzzles many law workers.This problem is all the more severe in the context where Insurance Law of China does not prescribe clearly enough the excess insurance.This paper,starting with an insurance case,analyzes in depth the legal basis and lawmaking practice of the excess insurance system,and offers tentative suggestions for how to solve the problems in China's excess insurance system.
