| 摘 要： | 无效行政行为理论的产生是行政法学的一大进步,在我国的行政法制建设中尤其具有现实意义。这一理论是对公定力的否定,其理论依据、判断标准一直受到争议。我国的立法对无效行政行为没有明确系统的规定,应在行政程序立法中确立无效行政行为。
