河南省民事审判工作中存在的问题及对策探究

公正与效率是21世纪人民法院的工作主题。在河南省民事审判工作中,存在着程序和实体等诸多方面的问题。少数法官存在的思想政治素质不高,业务水平低,执法为民意识不强,以及对法官的管理措施落实不到位等问题,是导致河南省民事审判工作产生诸多问题的主要原因。因此,为使法律真正成为“公平正义—秩序—社会效益”的统一体,必须采取多种措施和对策解决河南省民事审判工作中存在的问题。只有提高认识,更新观念,树立为党和国家工作大局提供司法保障的理念,改革现行法院经费管理体制,注重审判程序公正,深化审判方式改革,建立高素质的民事法官队伍,健全错案追究制度,才能真正实现司法公正,维护公平正义,促进河南省经济发展和社会稳定。

Study of the problems in Henan Province civil trial and the solutions

s: Just and efficiency is the aim that the court of our country should try to get in the 21st century. There are some problems such as in the procedure, the substantive and other respects in the civil trial of Henan province. The lower level in the thought and political quality of some judges,the lower professional level, some mistaken ideas to enforce the law strictly for people, the lack of necessary measures on administrating judges and other factors are the main causes that lead to the problems. So, to establish the uniform law body of "fair and just-order-social efficiency", we must take mult-measures and resolutions to solve the problems in Hennan province civil trial and the solutions. Only if we enhance and renew the acknowledge on the trail,hold on the idea that gives judicial safeguard for the social order of the Party and our country's work,reform the present administrative system on the court fund,emphasize the fair of trial procedure, deepen further the reform of the mode of trial, enhance the high quality of judges and establish the system of investigating into misjudge cases, we can carry out the judicial just, bring our society fair and just, promote the development of economy and remain society stable in Henan prorinle.
