| 摘 要： | 国际习惯法在其他国家的适用情况表明,各国大都在宪法中规定了国际习惯法的适用,对国际习惯法在国内的适用大多采取了采纳方式。而国际习惯法在我国国内的适用在我国《宪法》中没有明文规定,本文认为,我国应在参照其他国家做法的基础上,结合我国实际,在《宪法》和《立法法》中对国际习惯法在我国国内的适用问题予以规定。

| Abstract: | The situation how International Customary Law is applied in foreign countries indicates that most foreign countries have the application of International Customary Law stipulated in their Constitutions.It can be applied by adoption rather than transformation.In our country,our Constitution has no stipulation about International Customary Law(however,some scholars think it is stipulated in Department Law).Refering to other countries,the author thinks International Customary Law should be stipulated in our Constitution and Legislation Law. |
