| 摘 要： | 基于诉讼效率研究需要,通过对辩诉交易制度进行成本-收益和博弈论的分析,来考究这一制度的积极意义,并探究该制度在我国移植的必要性和可能性,以求借鉴其最大效用,建立中国式的辩诉交易制度,提高诉讼效率,构建节约型的和谐社会。

| Abstract: | To meet the need of lawsuit efficiency research,this article tries to determine the positive effect of plea bargaining by means of cost-profit analysis and game theory.It investigates the necessity and possibility of constructing the system of plea bargaining in China.It holds that the adoption of plea bargaining in China may contribute to the improvement in lawsuit efficiency and the building of an economical,harmonious society. |
