中国与南海邻国共同开发南海油气资源的困境与突围

南海问题是我国当前面临的重要海洋划界问题,由于地理、政治、经济以及法律等多方面的原因,中国与南海各邻国至今未能妥善解决南海划界问题。《联合国海洋法公约》要求各国在海洋划界前尽一切努力作出实际性的临时安排,而共同开发作为临时安排在南海实施共同开发油气资源时同样陷入多重困境。文章对目前共同开发南海油气资源所面临的困局及其原因进行分析,在此基础上探讨如何破解目前面临的困境,对我国解决南海问题具有重要的理论价值与实践意义。

Difficulties and Solutions for China and the South China Sea Neighbors to Jointly Develop Oil and Gas Resources

The South China Sea issue is an important maritime delimitation problem facing China at present. Due to geographical, political, economic and legal reasons, China and its neighbors in the South China Sea have not yet been able to solve the problem of the delimitation of the South China Sea. The United Nations Convention on the Law of the Sea requires states to make every effort to make practical temporary arrangements before delimitation, while joint development, as a temporary arrangement, is also in multiple predicaments in the South China Sea. Based on the analysis of the dilemma and its causes of joint development of oil and gas resources in the South China Sea, this paper explores how to solve the current dilemma, which has important theoretical value and practical significance for China to solve the problems in the South China Sea.
