我国司法解释制度改革路径探析——以《澳门刑事诉讼法典》“统一司法见解制度”为视角

近年来，对我国司法解释制度进行改革的呼声在法学界日渐高涨，但一直没能在实践中有所突破。《澳门刑事诉讼法典》中的统一司法见解制度融合了两大法系在适用法律方面的制度优势。它专门为统一法官对法律的不同解释而设立，在功能上与司法解释类似；又由于该制度根植于个案之中，对我国目前“同案不同判，同法不同解”现象有很好的遏制作用；且该制度符合我国目前的制度构架和司法技艺：值得我国在司法解释制度改革中予以借鉴。
