| 摘 要： | 建立离婚损害赔偿制度是我国婚姻立法的一大进步。本文认为,离婚损害赔偿是对侵犯配偶权行为导致的损害赔偿,应以受害方配偶、子女和与配偶共同生活的任一方配偶父母为请求权主体。同时,离婚损害赔偿的责任主体还应扩大到第三者。

| Abstract: | It is a big progress to establish compensation system of divorce damage in Chinese marriage legislation.In this paper,it believes the request right of compensation for damage is also suitable for the aggrieved spouse,the children and their parents who lives together.It brings the third party's compensation liability in the subject of liability to expand legal adoption yet. |
