论转基因产品安全应急处理法律制度

<生物多样性公约>和<卡塔赫纳生物安全议定书>关于应急处理的规定为各国生物安全应急处理立法提供了指南和参考.在我国,宪法、环境保护法律法规和其他相关法律法规就应急处理作出了一些规定,但这些规定存在诸多问题.我国转基因产品安全应急处理制度应从应急预案机制、肇事者的应急义务、主管部门的应急义务、法律责任等四个方面作出系统而全面的规定.

The Law of Emergency Disposal System of Transgenic Product

The articles on emergency disposal in the Convention on Biosafety and the Cartagena Protocol on Biosafety provide guideline and reference for the domestic legislation on emergency disposal. Some countries have established the emergency disposal system in the constitution, plan, environmental protection law and biodiversity protection law. In China, this kind of stipulations can be found in the Constitution, the environmental protection laws and other relevant laws and regulations. The emergency disposal system on biosafety protection of China is mainly stipulated in five regulations, with some problems to be solved. It is suggested that the emergency disposal system of transgenic product law of China include the emergency response plan, the emergency duties of the troublemakers and the administrations, and corresponding legal liabilities.
