| 摘 要： | 司法正义包括程序正义和实体正义,在实践中我们根据程序来判断正义。本文由莫兆军案入手阐述了程序正义的概念,分别论述了程序正义的五个标准,并就程序正义在司法实践中的不足与完善展开了讨论。
