论刑事和解的社会效应

刑事和解在缓解纠纷双方对立关系、节省司法资源的同时会削弱刑罚的预防功能、损害社会民众的法制信心,对社会的发展及稳定产生一些消极作用或影响。刑事和解对社会的影响程度通常取决于刑事和解适用理由的公开透明性、适用结果的合情理性以及纠纷双方和解意愿在和解过程中的被尊重程度。因此,我国司法机关在加大对社会民众进行刑事和解宣传教育的同时,应注重刑事和解处理结果的合情理性,另外,我国立法机关也应尽快完善刑事被害人国家救助制度的立法。

On the Social Effect of Criminal Reconciliation

Criminal reconciliation can relax the tension within parties and save judicial resources,but at the same time,criminal reconciliation will bring some negative effects which will influence social stability and development,such as reducing the preventive effect of punishment or decreasing people’s legal belief.The impact of criminal reconciliation on society can be influenced by many factors such as the transparency of applying criminal reconciliation,the reasonability of the results of criminal reconciliation,and the degree of respecting the wish to reconcile on both parties in the process.Therefore,the criminal justice organization must attach importance to educating the public about criminal reconciliation,and the reasonability of the results of criminal reconciliation.In the mean time,the court must perfect the national help system about criminal victim as soon as possible.
