| 摘 要： | 法律制度的有效性是指法制的积极的社会影响,它的实现是社会法律制度因素和法制的社会基础综合作用的产物。法律制度有效性的社会基础包括国家与社会相互分离与彼此互动的社会结构、现代市场经济体系和民主政治制度。
