| 摘 要： | "高级法"(Higher Law)对国家制定法的约束是宪政的基本要求.从高级法的渊源探索,中国的高级法应蕴涵在民间法中,体现在民间法具有成长为高级法的潜质,包括产生形式的天成性,对传统的维护所体现出的社会保守性,所蕴涵的自然正义以及对多样性的尊重.但民间法与高级法之间还横亘着一段距离,主要是民间法的合理标准障碍和因与传统割裂所形成的效力障碍.民间法成长为高级法,其前奏在于国家法与民间法的多元化法律格局的形成.

| Abstract: | A basic belief of constitutionalism is that statutes should be restrained by higher law.Studies on the origin of higher law indicate that higher law in China germinated from Chinese folk law based on the fact that Chinese folk law has the potentialities of higher law.Such potentialities include the naturalness of the generation form,the conservativeness in defending traditions,the natural rightness and the respect for pluralism embodied in Chinese folk law.Nonetheless,there is a big gap between higher law a... |
