东亚地区建立自由贸易区的法律框架初探

区域贸易协定与多边贸易体制的并行发展是当代国际经济关系中的一个重要趋势。目前,世界其他地区已经遍开区域经贸合作之花,而东亚地区也开始了区域经贸合作的初步尝试。本文旨在从国际法角度,探讨在东亚地区建立自由贸易区的法律框架。本文首先通过分析区域贸易协定与多边贸易体制的关系,肯定了区域贸易协定在国际贸易自由化中发挥的作用;接着介绍了区域贸易协定在东亚地区发展的现状与问题,并赞成在东亚地区积极推进自由贸易区建立。然后,从缔结自由贸易协定的一般性问题、相关实体性条款的应有规定、争端预防与解决机制等方面初步构想了东亚自由贸易区的法律框架。最后,本文呼吁借鉴其他地区的成功经验,加快自由贸易协定示范文本的制定,为东亚自由贸易区的建立而共同努力。

First Exploration of the Legal Basis to Build up Free Trade Zone in East Asia

The juxtaposition of regional trade agreement and multilateral trade system forms an important trend in the current international economy.While regional trade cooperation prevails in many areas in the world,East Asia begins to try the cooperation.Starting from the international law,this thesis tries to discuss the legal basis to build up free trade zone in East Asia.Firstly,by analyzing the relationship between regional trade agreement and multilateral trade system,this thesis affirms the role of regional trade agreement in trade liberalization.Secondly,the thesis reveals the progress and problems in the regional trade agreement in East Asia.Thirdly,the thesis suggests the legal basis for the free trade zone in East Asia.Finally,the thesis advocates that,in order to build up the free trade zone,East Asia should learn the successful experience from the other areas of the world and accelerate the composition of the model text of the agreement.
