在对非物质文化遗产的保护方面,民间法因其地域性、民族心理性而与非物质文化遗产有着密切关系,使其在参与非物质文化遗产保护时,具有发挥主导作用、形成主动全面保护、"三同时"保护和等边保护机制的可能性.但是,发展市场经济的冲击、大量能工巧匠的减少及民间法自身的缺陷,极大地削弱了民间法对非物质文化遗产保护发挥作用的可能性.应摒弃对非物质文化遗产不顾代价的消耗,充分发挥民间法的优先适用效益,切实保护好传承人并建立有效的传承模式,依托民间法建立有效的外附激励机制和公平激励机制,设立专门基金会等,以发挥民间法对非物质文化遗产保护的作用.
