| 摘 要： | 由于财产保险合同的特殊性,民法上买卖合同所有权转移的一般原理,不能完全适用:保险标的因法定 原因而转让的,财产保险合同当然转让,因约定而转让的,则不能。当保险标的所有权转移时间与交付时间不一 致时,应以后者作为财产保险合同转让时间。

| Abstract: | Because of the speciality of the contract of property insurance, the general principle of contract transfer in the civil law does not correspond to it. If it corresponds to the legal terms, the contract can be transferred. If it corresponds to the agreed terms, the contract can not be transferred. When the time of delivery is different from the transfer time arranged in the legal document, we should take the time of delivery as the time of property insurance contract. |
