| 摘 要： | 理论上,离婚损害包括单纯的离婚损害和离因损害,以此为依据可以得出结论:我国现有的离婚损害赔偿制度实际上仅是离因损害赔偿.本文系统分析了该项制度的构成要件,指出了其中的不足之处.此外,本文比较了瑞士、法国和台湾地区民法有关离婚损害赔偿的规定,并提出了完善离因损害赔偿和构建离婚损害赔偿制度的立法建议.

| Abstract: | Divorce damage includes two kinds: one is what is caused by the act leading to divorce; the other is what is caused by divorce. Based on this,we can get a conclusion that the system of divorce compensation in our country is actually the only compensation because of the act leading to divorce. The article analyzes the component of this system and their limitations. After discussing the comparisons in some provisions on divorce compensation in different countries and regions, the author puts forward suggestions to amend the system of divorce compensation. |
