中国行政法20年来民主化发展与未来趋势

我国行政法学界对于行政民主转型和行政法的民主化发展的认识是逐渐统一和深化的。随着行政契约、行政指导、行政奖励、行政公开、行政参与、民主监督等一系列体现行政法民主性增强的制度的建设,行政法学者突破传统行政法观念的束缚,勇于理论创新,逐渐开展了类型化、系统化、专门化的学术研究,取得了日益显著的成绩,指导和促进了我国行政法治的发展。然而,我国行政法民主化的发展还受到传统政治文化、行政文化、法律文化以及现行体制运作所提供的发展背景和社会架构的制约,我国行政法的基础理论、基本原则,主体理论与制度、行为理论与制度、监督救济理论与制度等还需要继续向民主化发展,从而实现行政的民主化、法制化,促进我国的行政法治建设。

Twenty Years' Development and Future Trend of Democratization of Administrative Law in China

This article researches the development phenomenon of democratization tendency in a perspective of value pursuit.It expounds the rule of increasing trend of democratic nature in administrative law,surveys the systematic reflection and macroscopic background on the democratizing development of the administrative law in China, analyzes its positive value and confining factors and also discusses its tendency in the future and cardinal subjects .It aims to provide a common agreement on democratic administrative law and promote the construction of rule of administrative law in our country.
