合作金融机构应对金融危机的法律制度设计 ——基于欧美与非洲的经验

通过对欧美与非洲相关数据的比较分析发现,合作金融机构比商业银行应对金融危机的能力更强,但是非洲合作金融机构抵御金融危机的优势却不如欧美那么明显。原因在于合作金融机构经营目标的非营利性、资金筹集的特殊性和管理控制的民主性,以及欧美的合作金融机构比非洲的运作更规范、制度更健全。中国、非洲等国家只有坚持按照合作制原则,改革并规范基层合作金融机构、健全不同层级的合作金融联合机构和有效的风险分担机制,完善合作金融立法,才能充分发挥合作金融机构的价值和功能,彰显其相对于商业银行的比较优势。

Legislation Suggestions on Cooperative Financial Institution Dealing with Financial Crisis——Based on the Experience of Europe, America and Africa

Through comparing and analysing European and American and African relevant data,it is discovered that cooperative financial institution has the stronger ability to deal with the financial crisis than commercial bank,but the advantage that African cooperative financial institution resists the financial crisis is not more obvious than that of Europe and America.The reasons lie in non-profit-goal of cooperative financial institution,particularity of the fund collection,democracy of management control,as well as that,the operation of European and American cooperation financial institution is sounder than that of Africa.Countries such as China,Africa,only adhere to the cooperation principle,reform and standardize the basic cooperative financial institution,perfect the different level of cooperation finance union body and the effective risk sharing mechanism,consummate the cooperation finance legislation,can the cooperative financial institution display fully its value and function,reflect its comparative advantage in comparison with the commercial bank.
