| 摘 要： | 在近代责任自负的法律理念影响下,我国抛弃了对知情不报行为追究刑事责任的传统。现有的反贪污贿赂机制的缺陷使反贪污贿赂工作耗费巨大却收效甚微。在借鉴古代及域外对知情不报行为追究刑事责任的前提下,提出对国家工作人员知晓他人贪污贿赂行为而不报的行为追究法律责任,以期进一步完善我国职务犯罪立法,进而为惩治贪污受贿犯罪有所裨益。

| Abstract: | Chinese Criminal Law does not provide for failure to report corruption and bribery crime.It leads to costly work and little effect for fighting against corruption and bribery.This article draws on the ancient Chinese and foreign criminal legislation and proposes that the national staff should report corruption and bribery,or they should be investigated for criminal responsibility. |
