论依法行政的外部制约因素

自 1 997年我国正式推行依法治国基本方略 ,确立建设社会主义法治国家目标 ,大力实施依法行政以来 ,历经三四年来各级政府的努力 ,初显成效。然而 ,新世纪 ,特别是中国加入世界贸易组织后 ,我国的依法行政成为法治化的重点和焦点 ,它面临的诸多外部制约因素 ,成为政府自身和国内民众及国际社会共同关注的重大中国政治发展问题之一。首先是改革和发展进入了新阶段 ;我国依法行政必须善于应对国际冲突和国际互动 (合作 )这样一种无可回避的国际关系局面 ;国际和平与国内稳定是制约一个国家依法行政的重要前提性因素。

On the External Restricting Factors of Administration by Law

Ever since 1997 our country carried out the fundamental guideline of governing by law and the goal of establishing a socialist country governed by law as well as the forceful practice of administration by law,achievements have been made in the recent four years.However,in new century,especially upon Chinese entry into the WTO,administration by law has become the key to the legalization of our country.It faces many external restricting elements and becomes one of the important issues in China's political development,which is the common concern of the government,the public and the international communities.First,the reform and development have gone into a new phase;the administration by law must be made capable of handling such inevitable situations in international relationship as international conflicts and interaction (cooperation);international peace and domestic stability become an important prerequisite which restricts a country's administration by law.
