| 摘 要： | 在未成年人犯罪案件中，引入人格调查制度，有利于深入剖析未成年被告人的犯罪原因，对其采取有针对性的刑罚及矫正措施，从而最大限度增强教育矫正效果，预防重犯。目前我国存在着司法实践中面临的社会调查主体不统一、适用范围受限、社会调查程序缺失、社会调查报告法律性质不明确、社会调查方法落后等问题。针对这些问题和不足，结合作者的司法实践经验，提出了完善该项人格调查制度的若干建议和措施。

| Abstract: | The personality survey system is conducive for an in-depth analysis of the causes of crimes committed by juvenile defendants, the targeted punishment and correction measures, so as to maximize the strengthening education and prevention of crime. At present, we are facing problems of the limitation of legislation, the unified judicial practice of social investigation, the limited scope of application, the social investigation procedure, lack of clear legal social investigation, and the backwardness of social survey methods. In view of these problems, combined with the author＇s experience in judicial practice, the present paper puts forward some suggestions and measures to perfect the personality survey system. |
