| 摘 要： | 我国民法的人格权制度及婚姻家庭制度通过对一般人格权和具体人格权的保护，从本质上保护、实现了人的尊严、自由、生命与身心健康等人格利益。婚姻家庭法兼顾个人与社会的双重价值决定其所确立和保护的人格利益必然具有双重性。无论是婚姻家庭关系中的人身关系，还是财产关系都与人格权及人格利益密切相关，对婚姻家庭关系的人身关系与财产关系的合理调整就是对人格利益尊重与公平分配，是实现人格权的有效途径之一。
