论道德法律化限度研究的基本路径——以对传统的研究路径反思为中心

道德法律化限度具有重要的理论与实践的研究价值。传统的道德法律化限度研究主要采取3种路径：原则论、道德层次论以及社会发展论。这些研究路径由于缺乏合理的研究立场，采用了片面的研究方法，产生出理论与实践上的弊端。道德法律化限度的研究应该坚持“伦理中心论”的研究路径，即基于伦理学的研究立场，通过对道德法律化限度语境中的道德作逻辑与历史相统一的考察，分析不同部分的道德与法律之间的关系，进而才能得出道德法律化应遵循的合理限度。
