城市房屋拆迁中的法律适用及其对策

通过问卷和个案访谈的方式对四个省房屋拆迁中的纠纷与法律适用问题的社会调查表明《国有土地上房屋征收与补偿条例》的实施过程中存在着一些问题。从根本上解决这些问题,政府应完善房屋拆迁法律制度,尤其是提高补偿计算标准,方能有效化解拆迁中的矛盾。而从体制层面来看,法治是解决拆迁问题的根本途径。

Legal Application and Strategy of the Expropriation of Buildings on State Land

By the way of questionaire and case interview, the social surveys about disputes and legal application problems of exproriation of buildings in four provinces show that there are many problems in the application of the act of the expropriation of buildings on state land.
