| 摘 要： | 人民陪审员制度与人民监督员制度具有相似之处，也具有差异。人民监督员制度发展完善在合法性论证、刚性约束力赋予、具体制度设计和立法路径选择方面多大程度上能够借鉴人民陪审员制度，根本上取决于两种制度性质定位及由此决定的两种制度的共性与差异，需要具体问题具体分析。

| Abstract: | Similarities and differences are found between people＇s jurors system and people＇s supervisors system. What we can learn from people＇s jurors system in demonstrating legitimacy, giving rigid binding power, designing specific system, location of them, and and choosing legislative routing of people＇s supervisors system, fundamentally depends on the the similarities and differences decided by the location, so we need specific analysis. |
